The Research and Technology Law group supports the University’s Research mission and provides legal advice on technology and intellectual property issues related to sponsored research. This does not include general copyright or trademark issues, which are handled by the General Law group.
The bulk of our practice consists of reviewing, drafting, and negotiating sponsored research contracts, including industry-sponsored agreements, federal and state grants, teaming agreements, subawards, consortium agreements, material transfer and clinical trial agreements, nondisclosure agreements, and licenses. We also provide Training to the Pre-award offices at Main Campus and HSC on various topics related to sponsored research.
We work closely with STC.UNM, the University’s technology transfer group, to identify University inventions, effectuate assignments, and assist in resolving issues of ownership in order to promote commercialization of the University’s intellectual property. We are responsible for compliance with all federal regulations related to sponsored research, including the Bayh-Dole Act, which requires us to notify federal sponsors of University inventions created with federal funding.
We address specific research compliance issues such as human and animal subject research, conflicts of interest in research, biosafety and biosecurity, export control, and research fraud. For more on these and other compliance matters, click here Compliance.
Finally, we assist the University in the development and revision of its policies relating to research, technology transfer, and intellectual property. Links to the University’s current policies, and other useful guides are available under Resources.
The Regents, President, Vice Presidents, Deans, and Directors seek legal service directly from the Office of the University Counsel. Other members of the University community seeking legal advice on University business, including faculty, staff, and students, are asked to have their request reviewed by the appropriate supervisor and forwarded to the Office of University Counsel by one of the officers above.
